Luxembourg – to reform commercial and financial justice

This week, the Minister of Justice, Elisabeth Margue, has submitted to the Government Council two draft bills, which are yet to be formally published, aimed at modernising Luxembourg’s legal framework in commercial and financial matters.

The first draft bill provides for the creation of specialised commercial and criminal chambers dedicated to economic and financial law.

This reform is intended to enhance the efficiency, consistency, and overall quality of judicial decision-making in increasingly complex business and financial disputes.

It also reflects a clear investment in judicial resources, with the planned recruitment of nine additional magistrates, alongside a reinforced focus on specialised training in economic and financial matters.

The second draft bill focuses on the digitalisation of insolvency proceedings.

It expressly introduces the possibility to file and register summons, appeals, and petitions in bankruptcy and judicial reorganisation matters through electronic means. This development is expected to streamline procedural steps, reduce administrative burdens, and accelerate the handling of cases, in line with broader efforts to modernise the justice system.

Taken together, these initiatives illustrate Luxembourg’s continued commitment to maintaining a modern, efficient, and business-oriented legal environment.

By promoting both procedural efficiency and judicial specialisation, the proposed reforms are likely to further strengthen the country’s position as a leading financial and commercial hub.
